St. Charles Twp. man charged with DUI, drove car into Elburn yard

Passenger charged with resisting arrest

ELBURN – A St. Charles Township man was charged with driving under the influence of drugs after his car got stuck in the side yard of a residence in Elburn, according to police reports.

Sethe M. Roberts, 21, of the 400 block of Valley View Drive, St. Charles Township, was also charged Feb. 28 with driving on the sidewalk, according to reports.

His companion, Dylan R. Padula, 19, of the 400 block of East Willow Street, Elburn, was charged with two counts of resisting or obstructing a police officer and possession of adult use marijuana in a motor vehicle, reports stated.

Police were called to a house shortly after 11 p.m. on Feb. 28 because a vehicle was stuck in their yard, reports stated.

The house is on the northwest corner of Weston Court and Prairie Valley where the driveway and front of the house face Weston Court.

“I observed a vehicle stuck in the snow, facing westbound,” the report stated. “I could see that the location of the vehicle was in line with the sidewalk, as if the vehicle had been traveling on the cleared sidewalk before becoming stuck in the snow. It was approximately 25-30 feet from the side of the road.”

After speaking to the driver, later identified as Roberts, the officer detected the odor of fresh marijuana coming from within the vehicle, the report stated.

“As the driver spoke, his words were slurred. His eyelids were droopy and I observed his eyes to be bloodshot and glassy,” the report stated. “I did not detect the odor of any alcoholic beverage coming from within the vehicle.”

Roberts told police his car slid on the ice and that is how he ended up in yard, the report stated.

After placing Roberts in the back seat of the squad car, police then turned to his passenger, Padula, who “was argumentative and uncooperative,” the report stated.

Padula had a backpack on the passenger side floor between his feet, the report stated.

Padula’s father arrived and the officer told Padula he could wait in his father’s car for warmth, the report stated, but Padula attempted to collect his belongings from Roberts’ car, the report stated.

“Padula attempted to push past me to gain access to the car,” the report stated. Both officers “placed hands on Padula to prevent his access to the vehicle and to direct him away from the car. Padula began to push and pull away from officers and actively resisted our efforts to keep him away from the vehicle.”

Officers brought Padula to the ground and pinned him there while he screamed for his father, throughout this struggle, the report stated.

“From the time Padula began actively resisting police to the time he was placed in handcuffs was approximately 53 seconds,” the report stated.

The backpack contained marijuana in various forms as a flower, vape and wax, about 8 grams and one prescription bottle, the report stated.

Meanwhile, Roberts was continually argumentative and abrasive, the report stated.

“Roberts’ speech was consistently slurred and mumbled, consistent with someone who is under the influence,” the report stated.

At one point, Roberts slipped the handcuffs from underneath his backside to the front and was attempting to take a pill, but police prevented him from getting it to his mouth, the report stated.

“Roberts claimed that he found the pill on the ground of the squad car,” the report stated. “He denied ownership of the pill.”

Police reviewed the squad car and booking room footage of Roberts. It showed Roberts reaching into his pants and underwear and removing a container, dropping his head out of view, “but it is evident that he is ingesting an item,” the report stated.

The booking room footage showed Roberts turning his back to the door and camera, but he is seen removing a bottle from his underwear or crotch area and ingesting an unknown item, the report stated.

“A … file was submitted to Tri-Com, indicating that Roberts is able to slip handcuffs from behind him to the front, and his penchant for keeping drugs in his crotch,” the report stated.

Roberts was released on a personal recognizance bond and is to appear in court on April 1 for plea setting.

Padula is to appear in court April 9 for plea setting.
