SUGAR GROVE – A Sugar Grove man is facing two felony charges in connection with allegedly spitting at a police officer and a paramedic, according to police reports and court records.
Anthony S. Duran, 35, of the 0-99 block of Winthrop New Road, Sugar Grove, was charged June 22 with two counts of felony aggravated assault of a police officer and two misdemeanor charges each of resisting a police officer, assault and one count of disorderly conduct, according to court records.
Police were called to Open Range Southwest Grill, 1 Golfview Road, Sugar Grove at 9:45 p.m. June 17 in response to Duran being intoxicated, suicidal and taking his clothes off within the restaurant, according to police reports.
The incident apparently began when Duran came into the bar and began bothering a female patron who moved away from him, according to the charging documents.
He began yelling at her and two other women, calling everyone names, pulling his shirt up and flicking his nipples, according to the charging documents.
Officers observed Duran smelling of alcoholic beverages, slurring his words and having a hard time keeping his balance, the report stated.
Officers asked him to come down from the top of the stairs but “he continued to shout obscenities toward staff/customers standing outside as well as officers on scene,” the report stated. “Anthony also made remarks about wanting to die and for us to kill him.”
One officer moved Duran away from the main entrance and escorted him to the parking lot while another officer requested paramedics to do a psychological evaluation of him, the report stated.
Duran continued being belligerent toward officers and “was starting to become enraged,” the report stated. “I feared that Anthony was about to start fighting with officers on scene due to his anger and his continued statements on wanting to be killed and die.”
Police had him sit on the ground in an effort to calm him, but Duran began “striking himself hard in his own facial area with open and closed hands while screaming uncontrollably,” the report stated.
Police tried to handcuff Duran to stop him from hurting himself or others, but he tensed up and resisted, pulling his arm away and struggled, the report stated.
After Duran was successfully handcuffed, he then spit at an officer,and at a firefighter/paramedic, the report stated.
Paramedics took Duran to AMITA Health Mercy Medical Center in Aurora where he was admitted, the report stated.
Aggravated assault of a police officer or emergency worker is a Class 4 felony punishable by one to three years in prison and fines up to $25,000, if convicted.
