Batavia motorcycle fatality leads to lawsuit

BATAVIA – A motorcycle fatality at Randall Road and Main Street in Batavia has resulted in a wrongful death lawsuit recently filed in Kane County. The crash took place about 8:20 p.m. Aug. 4.

A 15-year-old North Aurora teen, who had a valid learner’s permit, was cited in mid-August for failing to yield while turning left, which resulted in the crash, according to Batavia police.

Because she is a minor, the Kane County Chronicle will not identify her. She was driving with her father as her passenger.

Lara Speer, sister of the Oswego motorcyclist, Justin Retherford-Speer, 20, brought the suit against the teen and her father, asking for more than $50,000 in damages and legal costs.

On Aug. 5, Batavia Police Detective Kevin Bretz said the 2009 Pontiac Vibe car was heading south on Randall Road preparing to turn east onto Main Street, while the 1994 Kawasaki Ninja motorcycle was heading north on the inside lane of Randall Road approaching Main Street. Both had a green light, Bretz said.

The lawsuit argues that the car was driven carelessly and negligently. A court date of Nov. 17 has been set.
