SYCAMORE – A DeKalb County judge ordered a Cortland man listed as a sexual predator held in lieu of $50,000 bond on a felony charge of failing to register as a sex offender even though family members said he had registered.
David M. Matuszewski, 29, of the first block of East South Avenue, Cortland, was arrested at his home Sunday morning for a warrant on violating the sex offender registration act, according to a news release from the DeKalb County Sheriff's Office.
Judge Philip Montgomery kept bond at $50,000, citing a court services report that said Matuszewski was considered "high risk" to re-offend. The judge appointed the DeKalb County public defender's office to represent Matuszewski after the man's parents said they couldn't afford to hire an attorney on his behalf.
They also said that Matuszewski was registered in Cortland and was in the process of entering an in-patient rehabilitation program.
Matuszewski pleaded guilty in 2011 to charges of aggravated criminal sexual abuse and aggravated battery — the battery charge was because he reportedly spit in the face of a DeKalb police officer. The victim in the sexual abuse case was 16; Matuszewski was , records show.
He was sentenced to six years in prison, with credit for the time he had already spent in jail, records show.
Matuszewski is next due in court March 10. He remained at the DeKalb County Jail as of Monday evening.
