Kendall County will be in charge of completing public improvements for the Tanglewood Trails subdivision, but won't be on the hook for paying for it.
The subdivision's original developer, Tanglewood Trails LLC, was foreclosed in 2011 and the lender, Benchmark Bank of Aurora, was purchased by the FDIC in 2009.
The subdivision is located south of Legion Road along East Highpoint Road near Yorkville. Only four homes have been built in the subdivision out of the 40 that were originally platted, according to Jeff Wilkins, the county's administrator.
“It's one of those subdivisions that we are now having to clean up following the [housing] bust cycle,” board member Scott Gryder explained.
The county board approved a contract Sept. 15 with the new developer, BCB Development, and the Tanglewood Trails Homeowners Association. The board unanimously voted to have Chairman John Shaw sign the contract. However, board member Bob Davidson abstained from voting and board member Elizabeth Flowers was absent.
Wilkins said that the public improvements will mainly include road improvements and a stormwater collection system.
“The upshot is that the new developer, which is really a holding company … that acquired the subdivision lots through the FDIC after the previous banks had gone under, is now offering the county $85,000 to finish the improvements that weren't completed in that subdivision,” Wilkins said.
The money the county is receiving also gives the county board the authority to determine the improvements and the timing of the projects, Wilkins said, adding that there is an indemnity clause for the county in the contract.
Fran Klaas, the county's highway engineer, has met with the Kendall Township Road Commissioner to look at some of the items that weren't completed. The township has a list of items that they want to see done, and the township highway district would take over the maintenance of the infrastructure once it is complete, Klaas said.
The work will finally close out the subdivision, Wilkins said. The original developer, Tanglewood Trails LLC, entered into an annexation agreement in 2004 with Yorkville that was passed but never went into effect because the property is not contiguous with the city limits.
“This has been in the works since 2004,” Shaw said. “There has been an awful lot of work done on this to try to bring it to fruition.”
