Second lawsuit filed in 2012 fatal Campton Hills crash

A former Elburn woman who was injured in a fatal 2012 head-on Campton Hills crash has sued the estate of a Wisconsin woman who died in the crash, as well as a Wheaton man, according to court records.

Erin Pazin, currently of Elgin, seeks unspecified damages from the estate of Jennifer Liston and Bruce Greenberg of Wheaton, according to a lawsuit filed earlier this month.

Pazin was a passenger in a vehicle that was struck in a head-on crash on Dec. 1, 2012, in Campton Hills. The driver of the other vehicle was Liston, who died as a result of injuries in the crash, according to the suit.

Maple Park resident Zachary Bingham, 18, also was killed in the crash, along with his dog, according to the Kane County sheriff's office. Bingham, who was Pazin's boyfriend, was the driver of the car Pazin was in.

Pazin argues that Liston was negligent in operating the 2003 Nissan Altima that she drove in the crash. Greenberg was the owner of the Altima, and Pazin argues that he negligently entrusted Liston with his car. The complaint also states that Greenberg observed Liston consume alcohol before the Dec. 1 crash.

Diana Law, managing partner of the Law ElderLaw firm in Aurora, has agreed to be appointed as special representative of Liston’s estate, according to a petition in the case file. Neither Law nor Greenberg on Tuesday could be reached for comment.

A management conference for the case is scheduled for Feb. 19, according to court records.

The Bingham family filed the first lawsuit in connection to the crash against the Kane County sheriff’s office. That suit is next due in court Dec. 17.
