Lawsuit against Sheriff’s deputy gets dismissed

A suit filed against Grundy County Sheriff’s Deputy Brett Black was dismissed Wednesday, Aug. 3.

Todd A. Osinski, of 9 Cherry St. in Minooka, filed suit claiming false arrest. He alleged in the lawsuit that Black broke into the rear door of his residence without identifying himself and proceeded to arrest him in an April 11, 2009, incident.

The court dismissed the case on a motion by Black. Osinski has 30 days to appeal.

In 2009, Osinski was accused of approaching Deputy Black aggressively and threatening him.

Black then arrested Osinski for obstructing his performance of an authorized act and resisting arrest, according to the court file.

Those charges against Osinski were dismissed in Sept. 2009.

Osinski was demanding in the lawsuit a judgment in excess of $50,000 plus court costs.

The arrest in question occurred following an extensive search in the Shady Oaks subdivision that same day.

According to police reports, a woman returned to the Cherry Street residence to find Osinski unconscious on the floor. She called Minooka ambulance but while on the telephone, Osinski got up and left the residence.

Because of concern for Osinski’s condition, deputies reportedly conducted an extensive search for him, including receiving assistance from an Ottawa police canine unit.

Osinski returned to the residence later in the night. Deputy Black reported no one would answer the door, so he entered through an unlocked door, at which time Osinski came towards him.
