The family of a St. Charles teen injured in a crash that killed his classmate is suing another classmate accused of causing the drunken crash.
Colton Kumerow's parents Craig and Gina Kumerow filed a lawsuit last week against Onofrio Lorusso, 18, of Wayne.
The lawsuit is the third filed in the June 14, 2009, crash that killed 17-year-old Cameron Godee of West Chicago, and injured Kumerow and another teen – Chelsea Mertz.
Lorusso has pleaded not guilty to aggravated drunken driving and reckless homicide charges in the crash and awaits trial out on bond. The Mertz and Godee families also are suing Lorusso.
The most recent complaint states that Kumerow was a passenger in a 2005 Ford Explorer that Lorusso was driving drunk. The SUV was speeding and crashed into a tree, according to the lawsuit.
Kumerow "was injured, and has been subjected to pain, suffering, disability, disfigurement, medical expenses, and may continue to suffer all of the same into the future," the complaint states.
On Tuesday, Timothy Reuland, attorney for the Kumerow family, would not specify Kumerow's injuries, or comment on his recovery.
The lawsuit seeks at least $50,000, plus court costs.
The Godee and Mertz families make similar claims in their lawsuits, although the Godee family seeks more than $6 million from Lorusso. The most recently filed lawsuit will go before Judge Stephen Sullivan in May.
Sullivan will also hear the Mertz family's case, which is due next in court in October. The Godees' case will go before Judge Robert Spence next month.
Lorusso is due in court in the criminal case tomorrow. Prosecutors say his blood-alcohol level was 0.227 the night of the crash – more than twice the legal limit – and he had marijuana in his system. Prosecutors also claim Lorusso was speeding by more than 40 mph when he hit the tree head-on.
He has denied those claims. One of Lorusso's attorneys, Vince Solano, could not be reached for comment Tuesday.
