A man won his release from jail for a second time as he faces charges accusing him of shooting a man in Joliet and then harassing him about five months later.
On Wednesday, Judge Carmen Goodman granted a motion from attorney Chuck Bretz to lower the bond for Jesus Zambrano, 31, of Joliet over the objection of prosecutors.
Zambrano has been charged with wounding a man in a May 7 shooting and then harassing and assaulting him Oct. 30.
Zambrano’s $500,000 bond was lowered to $150,000. He would have needed to post $15,000 his release but Goodman allowed the $10,000 he already posted in another case to cover his current bond.
Zambrano was released from jail Wednesday after his sister posted $5,000, court records show. He was previously let out of jail on July 30 after Goodman lowered his bond from $500,000 to $100,000.
Goodman on Wednesday also denied a motion from prosecutors to schedule a hearing on the source of Zambrano’s bond money. Prosecutors filed the motion that alleged Zambrano planned to sell devices that turn pistols into machine guns.
Zambrano filed a petition for a certificate of innocence after a jury in 2019 found him not guilty of shooting and killing Robert Gooch in 2009. A judge has not ruled on that petition.
Will County State’s Attorney James Glasgow said his office obtained a conviction in Zambrano’s case when it was first tried in 2013.
“It is always difficult for witnesses to testify a second time, especially in a case such as this one where literally a decade has passed since the alleged conduct at issue occurred. We respect the decision reached by the jury in the retrial,” Glasgow said.
The 3rd District Appellate Court reversed Zambrano’s conviction in 2016 after finding his attorneys failed to impeach a witness with evidence that he received immunity to testify, as well as failing to tender a jury instruction for accomplice testimony.
Zambrano’s attorney, Neil Patel, said the prosecution’s case used testimony from Christian Lopez, a witness he said was not credible.
