Man shot by Joliet police officer charged with assault for displaying BB gun: records

A 29-year-old man who was shot three times by a Joliet police officer has been charged with aggravated assault in connection with the incident, court records show.

On Thursday, Judge Fred Harvey signed a $100,000 warrant for the arrest of Cordairel Martez Whitmore, of Joliet, on a felony charge of aggravated assault.

Whitmore was identified by the Will-Grundy Major Crimes Task Force as the man who was shot three times by a Joliet police officer in the 1200 block of Nicholson Street. The task force is investigating the shooting and Will County State’s Attorney’s James Glasgow will determine whether the shooting was justified.

The criminal complaint filed against Whitmore alleged that on Jan. 28 he “knowingly engaged in conduct which placed another, Brian Lanton, in reasonable apprehension of receiving a battery.”

“He displayed a BB gun, knowing Brian Lanton to be a peace officer performing his official duties,” the criminal complaint said.

When Whitmore’s mother was contacted about the aggravated assault charge, she said, “I have nothing to say, sir.”

The task force has not released the name of the officer who shot Whitmore.

Will County State’s Attorney spokeswoman Carole Cheney was unavailable to comment Friday. Joliet police spokesman Dwayne English did not immediately respond to a message and call.

Will County Deputy Chief Dan Jungles, the task force chairman, would not confirm if Lanton was the one who shot Whitmore.

“That information will be released by the task force once the State’s Attorney’s Office is through reviewing all reports,” Jungles said.

Jungles said the purpose of the task force is to investigate the shooting aspect of the incident by the officer that is involved and that the task force did not obtain the complaint warrant against Whitmore.

“We do not investigate the crimes that occurred prior to the officer discharging his weapon. That information is documented in the task force reports, however we are only interested in conducting an unbiased investigation into the officers’ actions,” Jungles said.

Jungles said the task force has been in communication with the Will County State’s Attorney’s Office since the start of the case.

“For the most part the task force has finished the investigation, with the exception of receiving some official records from various providers,” Jungles said. “Once a determination is made by the Will County State’s Attorney’s Office in regards to the officer’s actions in this officer involved shooting, those details will be released by an official press release.”

Task force officials previously said that after the shooting, Whitmore was in stable condition and alert at AMITA Health Saint Joseph Medical Center in Joliet.

“Mr. Whitmore spoke with task force investigators today and is fully cooperating with the investigation,” task force officials previously said.

In the task force’s account of the events, they said the gun Whitmore reportedly pointed at an officer was a Sig Sauer P365 air pistol that is “made to look and feel like the 9 mm version of this same handgun.”

In the first news release of the incident, task force officials said officers were “engaged in a conversation” with Whitmore when he “produced a handgun and pointed it at an officer.”

“The officer then fired shots at this individual, striking him multiple times,” task force officials said.

Officers “made the scene safe” and rendered medical aid to Whitmore, according to the task force. Whittier was taken to AMITA Health Saint Joseph Medical Center, where he underwent surgery.
