St. Charles Twp. man charged with felony aggravated battery

Man allegedly bit victim’s cheek

ST. CHARLES TOWNSHIP – A St. Charles Township man was charged May 30 with felony domestic battery after allegedly biting the victim on the cheek after they went to a cemetery for Memorial Day, according to Kane County Sheriff’s reports.

Earle C. Thomas, 34, of the 34W600 block of Elm Court, St. Charles Township, was charged with two counts of felony domestic battery because of a prior conviction for domestic battery in 2013, the report stated.

Thomas and the victim were returning from a cemetery shortly before 12:30 p.m. on May 30 and both had been drinking alcoholic beverages, the report stated.

They argued throughout the car ride and on the way back, with the victim driving and Thomas in the passenger seat, Thomas allegedly grabbed her neck area with his right hand and bit her on the right cheek, the report stated.

The victim dropped Thomas off at home and drove to the park at Weber Drive and Villa Maria Road in the Valley View area of St. Charles Township to call police, the report stated.

Deputies observed a red mark on the victim’s lower neck area but no bruises or cuts to her cheek; she wanted to pursue criminal complaints against Thomas, the report stated.

Thomas told deputies that they had a verbal argument, but had no idea how she got red marks on her neck and denied hitting her, the report stated.

Thomas told deputies she was emotional because of her deceased father, that she was under the influence of alcohol and that she was lying, the report stated.

The aggravated domestic battery charges are two Class 4 felonies, punishable by one to three years in prison and fines up to $25,000, if convicted.

As of Wednesday, Thomas was being held in the Kane County jail on $5,000 bond and is scheduled to appear in court on June 11, records show.
