Xandria Harris’ attorney is filing a motion for change of venue

The attorney for Xandria Harris said in Kankakee County court Friday she will be filing a motion for a change of venue.

It came during a scheduled court date.

Circuit Judge Kathy Bradshaw-Elliott set May 5 as the deadline for Cierra Norris to file the motion.

Bradshaw-Elliott is scheduled to hear arguments from Norris and Kankakee County State’s Attorney Jim Rowe at 10:30 a.m. May 8.

A change of venue is a legal procedure where a civil or criminal case is moved from one location to another in the same judicial system.

This typically occurs when the original location is not suitable for a fair trial, either because of strong local biases that could unfairly influence a jury or because another location would be more practical and convenient for all parties.

The trial is scheduled for Aug. 3-21.

Harris is charged with first-degree murder, attempted murder, and child endangerment following the Dec. 29, 2021, shooting that left Bradley Police Sgt. Marlene Rittmanic dead and Sgt. Tyler Bailey wounded.

Bailey’s injuries were so severe he was forced to retire from the police force.

The officers had responded to a call about barking dogs in a vehicle at the Comfort Inn in Bradley.

Harris’ boyfriend, Darius Sullivan, was the actual shooter. He was found guilty in 2024 and is serving a life sentence.

Attorneys were selecting jurors for Harris’ trial in February when both sides agreed abruptly to file a joint motion to continue.

The motion came after a 90-minute meeting on the third day of jury selection.

Norris forgot to put two names on her list of possible witnesses, including the doctor who was hired to be the defense’s expert witness.

There were also issues with the jury and social media. Those were discussed in private at the request of the attorneys.
