Man sues Route 59 McDonald's over hot coffee spill: records

A man filed a lawsuit claiming staff at a Joliet McDonald’s handed him hot coffee that was not properly secured and it spilled on him.

Alvaro Robles filed the lawsuit on Tuesday over the incident that occurred on Sept. 7, 2018, at 2220 Route 59 McDonald's.

The lawsuit names Kory Management, Kory Family McDonald’s, Nick Kory and Gary Kory as defendants in the case.

Robles’ lawsuit claimed he was at the drive-thru when the staff handed him a hot cup of coffee that was not properly secured and it spilled on him.

Robles’ lawsuit claimed the defendants failed to “see and observe the coffee lid was not properly secure,” handed a cup of hot coffee that was not properly secured and failed to train employees on “the procedures of handling hot beverages.”

The lawsuit said Robles “sustained severe and permanent disabling injuries and suffered acute and prolonged physical and mental pain and anguish” from the incident and that he spent “large sums of money for medical care and attention to his injuries.”

Robles has been “unable to attend his normal affairs and duties and has lost thereby great gains and profits which he would have otherwise made and/or acquired,” the lawsuit said.

Robles is asking for an award of damages in excess of $50,000.

In response to the lawsuit, Erica Jones, McDonald’s field public relations manager, said the safety and security of customers is “always a top priority and we take this matter seriously.”

“As this is pending litigation, we cannot comment further at this time,” Jones said.
