St. Charles police department conducts undercover investigation at Summer Spa Massage

ST. CHARLES – Two female massage therapists working at Summer Spa Massage in St. Charles have been charged with giving massages without a state license after undercover St. Charles police officers did compliance checks on the establishment in October and November following complaints of suspected prostitution and massage violations.

Dongyuan Wan, 32, and Xiyan Wan, 36, both of the 2000 block of South Tan Court, Chicago, have been charged with violating the state's massage licensing act. The city's liquor control commission is expected to discuss the violations during its meeting Monday.

Kevin Wendorf, the attorney for Summer Spa Massage owner Hong Shen, said in a letter to the city that the establishment "is a legitimate spa and no worker has ever been charged with prostitution. I am sure we can work something out."

Wendorf said the owner has tried "very hard to adhere to all of St. Charles' rules and regulations."

"There has been some miscommunication about some workers not having an Illinois Massage Therapist License but being certified by a National Organization for Asian Bodyworks (allowed under the exceptions in the Illinois Massage Act until Dec. 31, 2019)," Wendorf states in the letter.

Wendorf says that every employee at Summer Spa is now licensed by the state and that the owner understands that under the new law beginning Jan. 1, they must be.

Summer Spa is located in the former Tin Cup Pass shopping center at East Main Street and Tyler Road. The shopping center, which is getting a facelift, has been renamed Stone Creek.

According to police reports the Kane County Chronicle obtained through a Freedom of Information Act request, a St. Charles police officer on Oct. 16 entered Summer Spa and paid $50 for a half hour massage and provided a $10 tip. He was not solicited for any sexual acts in exchange for money, the report stated.

Officer said that the person who gave him the massage – Dongyuan Wan – told him to make an appointment and come back. In the report, the officer stated that telling him to make an hour long appointment with her "could be her way of hinting this is how he would then receive a sexual act from her."

The police department conducted another compliance check on Oct. 25. During the massage, the masseuse – Dongyuan Wan – allegedly had him lay on his back and a small towel was placed over his groin, the report stated.

Shortly after massaging his legs, the masseuse allegedly lifted the towel off the officer's groin and left it off, thus exposing his genital area, according to the report.

"She then put a large amount of oil on top of his genitals and left the towel off," the report stated. "When he asked the employee about other services (sexual acts) she did not oblige and told [the officer] to manipulate himself while she continued with the massage. [The officer] declined this offer and shortly after the massage was ended."

According to the report, the masseuse violated a section of the massage act in that she unlawfully and knowingly exposed the genital area of another person. She was not cited or arrested at that time, the report stated.

The police department on Nov. 8 conducted another massage compliance check at Summer Spa Massage. During this massage, Xiyan Wan allegedly took the officer's hand and told him that he could put it on her behind or her breasts while she continued with the massage, the report stated.

He pulled his hand away and declined this offer. The massage then ended and the officer left the building, according to the report.
