BROOKFIELD – After a five-month long investigation, the Riverside Police Department announced officers have re-arrested a Brookfield man who allegedly battered his pregnant fiance.
Benjamin G. Alvarez, 39, of the 3800 block of Hollywood Avenue, Brookfield, was charged with aggravated battery of a child, a class three felony, at 10 a.m. Monday.
Alvarez was charged with domestic battery in February in the 200 block of West Quincy Street in Riverside. Officers arrived on scene to find a 35-year-old woman with lacerations to her face, a swollen left eye, a swollen lip and stomach injuries.
Through the investigation, police said they discovered Alvarez had gone to a party against the victim's wishes and later found his belongings outside of the home when he returned. After a verbal altercation between the two escalated, Alvarez shoved the victim to the ground, climbed on top of her and began shoving her face into the hard packed ice and snow.
The victim, who was four months pregnant, was also kicked in the stomach and later transported to Loyola University Medical Center in Maywood, police said.
At the time, Alvarez was arrested for two misdemeanors; one count of battery to an unborn child and one count of domestic battery, although the charges were later dropped.
In March, Riverside investigators were notified that victim miscarried at 20 weeks.
The DuPage County Coroner's Office, which pronounced the baby dead, ruled the cause of death as undetermined.
Riverside investigators continued to examine the case and medical documents due to the belief that the beating contributed to the miscarriage.
Alvarez, on the advice of his attorney, surrendered himself to the Riverside Police Department Monday.
