A woman accused of firing a gun in a residential neighborhood during a fight with a family member now is charged with domestic battery in two separate cases involving the same family member.
As a result, prosecutors are asking a McHenry County judge to raise the amount Anita M. Gustafson, 59, of the 500 block of Delaware Drive, needs to post in order to remain out of custody, court records show.
Gustafson was charged in November with reckless discharge of a firearm as well as unlawful possession of eight marijuana plants and 100 to 500 grams of marijuana after police responded to her neighborhood for reports of shots fired.
The gun was fired during a fight with a family member, according to a motion filed last week by prosecutors asking Gustafson’s be released.
Gustafson’s initial bond was set at $5,000 and she posted $500 to be released, according to the motion.
Ten days after the initial charges were filed, on Nov. 15, she was charged with domestic battery, according to the motion. Prosecutors said Gustafson is accused of hitting the same family member in the face.
In that case, Gustafson’s bond was set at $3,000 but then reduced to $2,000 despite prosecutors’ objections, according to the motion. She was ordered not to have any contact with the family member.
Last week, after posting $200 to be released, Gustafson again was charged with domestic battery. This time, prosecutors said, for closing the family member’s foot in a car door.
The McHenry County State’s Attorney’s Office requested that her bond be increased to $75,000. A hearing on the request is set for Friday.
An attempt Monday to reach the McHenry County Public Defender’s Office, which is representing Gustafson, was unsuccessful.
