An Elwood man was sentenced Friday to probation plus time served for shooting out a car tire during a 2019 dispute outside a Lostant tavern.
John M. Buchanan, 66, pleaded guilty to one count of aggravated assault, a Class 4 felony that could have carried a prison sentence up to 3 years. However, there were no injuries resulting from the discharge and Buchanan’s record was blemished only by a years-old DUI.
In light of those factors, prosecutors agreed to 30 months probation plus 180 days in jail, which Buchanan already has served.
Buchanan declined an opportunity to address Judge Cynthia M. Raccuglia. A message left via his attorney went unanswered.
Buchanan was charged in October 2019 after a dispute outside Dave’s Lost Ant, during which he allegedly discharged a firearm toward a vehicle, blowing out the tire, and then left the scene, according to police and court reports.
