The Kane County Major Crimes Task Force investigation of a fatal officer-involved shooting in North Aurora last year found that lethal force was justified, and no charges will be filed against the officer, according to a news release from Kane County State’s Attorney Jamie Mosser’s Office.
Mosser’s office reviewed the findings of the investigation into the incident that happened outside in the 400 block of Pinecreek Drive in North Aurora on Aug. 10, 2021, and determined there “was reasonable belief on the part of the officers that it was necessary to use force intended to cause death or great bodily harm to prevent death or great bodily harm to the officers, and therefore the officer’s use of force was justified.”
Jim Wiesner, 51, was killed during the incident. According to a report from the North Aurora Police Department, police said Wiesner’s fiancee called police about 9:30 p.m. and reported that he was “acting erratically.”
The fiancee let three officers into the home and Wiesner approached them with a gun that he pointed at the officers. The officers exited the home and Wiesner followed them and ignored command to drop his weapon.
“As Wiesner approached one of the officers in the street, the officer fired his duty weapon at Wiesner, striking him in the upper body,” according to a police news release.
The officers involved in the incident were put on administrative leave during the investigation.
