Cortland man accused of violating restraining order after allegedly choking woman in November

CORTLAND – A Cortland man is being accused of violating a restraining order after allegedly choking a woman he knows in late November.

Eric L. Green, 30, of the 200 block of McMillan Court, Cortland, was arrested and charged with unlawful violation of an order of protection, a Class A misdemeanor. He previously was charged with aggravated domestic battery, a Class 2 felony, and domestic battery, a Class A misdemeanor. If convicted of the felony charge, Green could face up to seven years in prison.

According to DeKalb County court documents, Cortland police officers were called at about 1:35 p.m. Nov. 29 for a report of domestic battery. A woman Green knows told police she got into a verbal argument with Green, which she said turned physical, court records state.

“[The woman] stated Eric grabbed her from behind, choking her with his arms, causing her to pass out and lose consciousness,” court documents state. “Officers observed [the woman]’s neck to have reddish in color marks near her collarbone area.”

The woman filed an order of protection against Green in early December. Green allegedly arrived at the protected address and refused to leave, according to court documents.

Green previously was held on no bond until Thursday, when DeKalb County Judge Marcy Buick set Green’s bond at $5,000, with 10% to post, in open court. Green was present for the hearing from DeKalb County Jail via Zoom and is being represented by the DeKalb County Public Defender’s Office.

Green is due back in court 9 a.m. Jan. 20 for an arraignment hearing.
