Prosecutors seek forfeiture of car used in Joliet drive-by shooting: records

Prosecutors are seeking the forfeiture of a Dodge Durango that they said was used in a drive-by shooting in Joliet, court records show.

On Friday, Will County Assistant State’s Attorney Thomas Bahar filed a forfeiture complaint, which said the vehicle was used in the July 15 shooting. Police said a man was shot at by the occupants of the Dodge Durango but was not injured.

Derian Moreno, 24, the alleged driver of car, faces charges of aggravated discharge of a firearm, unlawful use of a weapon by a felon and aggravated fleeing in connection with the incident, court records show.

The forfeiture complaint alleged Moreno was in police custody after the shooting incident with Anthony Munoz, who was in the vehicle, and Moreno asked Munoz, “Did you post it on Snap? Did you [at] least save the video?”

The complaint claimed Moreno also said, “They shot at us first,” and that Munoz made a “spontaneous statement” to two Joliet police officers when he said, “How you like that FN, it’s cool ain’t it?”

An FN pistol was located in the area where Munoz was located and arrested, according to the complaint.

The two officers had heard about 10 shots fired east of the West Jefferson Street Jewel-Osco’s parking lot near John Street, according to the complaint.

The officers pulled out of the store parking lot and headed southbound toward Midland Avenue and John Street when they were flagged down by a man who yelled, “He shot at me. He went that way, white Dodge Durango,” according to the complaint.

The man told the officers he was being followed by a Dodge Durango, and at one point he ran toward his house when he heard several shots fired, according to the complaint.

He could see “dust and debris come up from the ground” and believed those were gunshots, according to the complaint.

The officers pursued the vehicle, saw Munoz jump out of the car and later found him “lying down in a fetal position” in the backyard playhouse of a residence on Douglas Street, according to the complaint.

Moreno drove to the dead end of Albert D’Ottavio Drive, where he was then arrested, according to the complaint.
