Cary man accused of 2017 sexual assault

A Cary man was arrested Thursday in connection with July 2017 rape allegations.

Miguel E. Hernandez has been wanted by police since Nov. 1 after McHenry officers received a report alleging that Hernandez sexually assaulted a woman who could not give consent, public records show.

Hernandez, 30, is charged with criminal sexual assault.

If convicted, he could be sentenced to as many as 15 years in prison.

The alleged assault happened July 9, 2017, public records show.

Additional details were not available, and several records filed in connection with the case have been impounded and are not available to the public.

McHenry police said Thursday that they would need more time to review the initial report before commenting on the case.

Hernandez made a brief court appearance at the McHenry County Jail on Thursday morning, when Judge Joel Berg set the man’s bond at $100,000, public records show.

Hernandez, however, must post $10,500 to be released from the jail because he has two additional traffic cases open in McHenry County.

He remained in jail Thursday afternoon and is scheduled to appear in court for a bond hearing Monday.

Berg also appointed the McHenry County Public Defender’s Office to represent Hernandez on the felony charge, but the office could not be reached for comment Thursday.
