DeKalb developer to pay $19K in plea agreement

A developer accused of taking money from the Gardens of RiverMist Homeowners Association will pay the group nearly $19,000 after reaching a plea agreement earlier this month.

As developer of the property, Ivan Krpan, 50, of DeKalb collected association dues and maintenance fees for the luxury townhomes off Sangamon Road between Rich and Bethany roads in DeKalb.

In February 2010, Krpan was charged with theft and deceptive advertising. The case was moved out of DeKalb County after a series of judges recused themselves because of their relationship with a potential witness.

On June 17, Krpan appeared in Yorkville in front of Kendall County Presiding Judge Timothy McCann and pleaded guilty to deceptive advertising. Krpan was sentenced to 12 months conditional discharge and ordered to pay $95 in court costs and $18,950 in restitution.

DeKalb County prosecutor Stephanie Klein said the restitution will go to the homeowners association, which now has a board of directors and is called the Townhomes of RiverMist Homeowners Association. As part of the plea agreement, Krpan paid $16,450 in restitution on the day of the plea.

Klein said the ability to immediately recoup a significant amount of loss for the victims was one of a number of factors prosecutors considered in offering the plea deal. She said the state's attorney's office and Krpan's attorney, David Camic, were close to an agreement before the case was moved to Kendall County.
