ST. CHARLES TOWNSHIP – A St. Charles Township man faces felony charges for possessing a gun in his car and illegal drugs he planned to deliver. Both were discovered by police July 14 after a routine traffic stop for driving with one headlight, according to a news release from the Kane County State’s Attorney’s Office.
Prosecutors charged Eric R. Fabisiak, 18, of the 6N700 block of Aurora Avenue, St. Charles Township with armed violence – a Class X felony – unlawful delivery of a controlled substance, unlawful possession of a controlled substance and three counts of aggravated unlawful use of a weapon, all felonies, the release stated.
Kane County State's Attorney Joe McMahon alleges in charging documents that on July 14, Fabisiak unlawfully possessed between 1 and 15 grams of cocaine in his car with the intent to deliver, while armed with a loaded, uncased and immediately accessible .32-20 Smith & Wesson revolver without a Firearm Owners Identification Card, the release stated.
According to St. Charles police, Fabisiak was driving a white Ford in St. Charles at about 9:15 p.m. July 14 when police stopped him in the 1600 block of East Main Street for having only one operating headlight.
St. Charles police found the gun and drugs in Fabisiak's car during the traffic stop.
Fabisiak appeared in bond court July 15 where Kane County Associate Judge Kathryn Karayannis set Fabisiak's bail at $50,000 with 10 percent or $5,000, to apply to be released on bond.
As of 6 p.m. July 16, Fabisiak was still in custody at the Kane County jail.
Conviction of a Class X felony, the most serious charge, carries a punishment of 6 to 30 years in prison with a fine of up to $25,000.
The unlawful delivery of a controlled substance is a Class 1 felony, punishable by 4 to 15 years in prison with a fine of up to $25,000.
The other four charges are punishable by 1 to 3 years in prison and fines of up to $25,000 on each one.
Fabisiak also recieved a traffic citation for driving with one headlight, court records show.
Fabisiak is to appear in court July 27 on the felony charges.
