DeKalb man charged with sexually assaulting two children free on signature

SYCAMORE – An 18-year-old DeKalb man accused of having inappropriate sexual contact with two girls younger than 17 is free on his signature.

Christian H. Rincon, of the 800 block of Edgebrook Drive, was arrested in March and charged with criminal sexual abuse and was released on his signature. He was arrested again Friday on the same charge, involving a different victim, and again freed on his signature.

DeKalb police Cmdr. Bob Redel said Rincon was at a party with a 16-year-old in October 2016, and as they walked home, he assaulted her, without her consent. Charges were filed March 12 and a warrant was issued for his arrest. If Rincon is convicted in that case, he could face four to 15 years in prison.

Chief Judge Robbin Stuckert granted his release on his signature in March, with the conditions he have no contact with any children and that he be placed on electronic home monitoring. Rincon’s lawyer, Joseph Colsant of Wheaton-based Fawell & Associates, has since filed a motion asking for a new judge, claiming Stuckert is biased against Rincon, the records show.

Rincon was arrested again Friday and charged with criminal sexual abuse of a child, which court records show happened Jan. 31. Redel said this girl, 15, offered her consent, but that charges were pressed because she’s not old enough to legally consent. Judge Philip Montgomery released Rincon on his signature again and, while he added that Rincon is not to have any contact with that victim, he ordered that Rincon no longer be on electronic home monitoring, according to court records.

Rincon is due back in court at 9 a.m. Friday.
