Lockport man sued by alleged sex abuse victim

Criminal charges were filed against the man last year

A Lockport man accused of sexual assault is being sued by his alleged victim, according to court records.

On March 14, a lawsuit was filed against Mitchell Gurra, 58, of the 16600 block of West Oneida Drive, accusing him of sexually assaulting a Lockport man in 2017. Gurra also has been indicted in connection with the alleged sexual assault.

The lawsuit claims that in early September 2017, Gurra knowingly assaulted the victim by engaging in sexual acts with him without his permission and while knowing he was “unable to give consent.”

Gurra allegedly committed battery against the victim as a result.

The lawsuit argues that as a “direct and proximate” cause of the sexual acts committed by Gurra, the alleged victim “sustained injuries of a personal nature and sustained and suffered severe emotional pain, anguish and mental suffering.”

The incident also caused the alleged victim to require psychological treatment and counseling, the suit said.

“The plaintiff’s parents expended large sums of money for the psychological treatment and counseling that plaintiff underwent,” the lawsuit claims.

The alleged victim seeks damages against Gurra in the amount of $50,000 or more.

On May 9, 2018, Gurra was indicted on charges containing similar allegations. He faces a charge of criminal sexual assault and criminal sexual abuse.

Gurra’s attorney, Ted Hammel, declined to comment on the lawsuit.

The next court date in the case is April 15.
