Harvard man faces additional drug possession charge while out on bond for LSD, marijuana charges

A 28-year-old Harvard man facing felony charges alleging he had possessed almost 900 tabs of LSD was arraigned Monday on an additional charge of possession and domestic battery.

Alek A. Montemayor, of the 1200 block of Orchard Lane, pleaded not guilty to a new charge of unlawful possession of a controlled substance for alleging possessing less than 15 grams of cocaine and domestic battery on May 23.

The initial charges resulted from a traffic stop on May 7 where police discovered nearly 900 individual perforated tabs of LSD, more than 30 grams of marijuana, three cellphones and a bag containing $13,950 in Montemayor’s vehicle, according to the criminal complaint filed in McHenry County courthouse.

In that case, he is charged with possession and possession with intent to deliver more than 30 grams of marijuana and possession and possession with intent to deliver LSD, according to charging documents.

Police also cited him with driving on the wrong side of the road, operating an uninsured vehicle, speeding, and driving while his license was revoked, according to court documents.

At the time, Montemayor was on felony probation related to a 2019 conviction of unlawful possession of a controlled substance, according to court documents, making him eligible for extended and enhanced sentences on his recent cases, McHenry County Judge Michael Coppedge said.

On the most serious charge of possession with intent to deliver LSD, he could be sentenced to as long as 30 years in prison.

A hearing for judgement on bond forfeiture has been set for March 29.
