La Salle County grand jury returns alternate count in drug-induced homicide

Mulcahy awaits final pre-trial hearing Wednesday

Prosecutors have prepared an alternate count of drug-induced homicide against a Lake Barrington man who allegedly supplied a drug to a 15-year-old. The teen died as result, prosecutors said.

A grand jury convened Tuesday and indicted Brian K. Mulcahy, 56, on a second count of drug-induced homicide, a Class X felony carrying 6-30 years and no possibility of probation.

Mulcahy is set to appear Wednesday for a final pre-trial conference. Barring a plea or continuance, he will stand trial after the holiday weekend for allegedly delivering, on April 18, an unspecified controlled substance containing fentanyl to an individual identified only as “C.J.M.” The teen inhaled a portion of the substance and died, Marseilles police said.

Alternate filings are common in homicide cases. Prosecutors sometimes file multiple counts, even when a single victim has died, to address the suspect’s alleged intent and/or states of mind.

Also indicted Tuesday were: Melissa Lowe, 50, of Ottawa (obstructing justice); Richard Jahns, 35, of Earlville (violating the sex offender registry); Cameron Jones, 25, of Oglesby (theft); Osiris Johnson, 20, of Chicago (aggravated battery); Christopher Cali, 34, of Mendota (resisting a peace officer); Talitha Sine, 37, of Ottawa (aggravated battery); Kevin Barnes, 37, of Cleveland, Ohio (cannabis trafficking); Willis Dixon, 41, of Flushing, N.Y. (cannabis trafficking); Ty Counsil, 34, of St. Charles (aggravated DUI; driving while revoked; unlawful possession of a controlled substance); Justin Westerhold, 28, of Streator (aggravated fleeing and eluding); Elijah Manuel, 36 of Joliet (driving while revoked); Guy E. Stanford, 47, of Mendota (two counts of child porn); Kevin Wilson, 46, of Ottawa (two counts of aggravated DUI); Nicole Leal, 39, of Marseilles (two counts of criminal trespass to a residence); Calvin Bennett, 36, of Ottawa (violating the sex offender registry); Dylan Combs, 18, of Ottawa (residential burglary); Brittany Biffany, 29, of Ottawa (unlawful possession of a controlled substance with intent to deliver; unlawful possession of a controlled substance); Eduardo Escatel, 36, of Ottawa (unlawful possession of a controlled substance with intent to deliver; two counts of unlawful delivery of a controlled substance); Michael Johnson, 35, of Ottawa (two counts of unlawful delivery of a controlled substance); Elijah Scott, 25, of La Salle (unlawful delivery of a controlled substance).
