A Power of Attorney is a legally binding document that allows a designated agent to make decisions regarding another person’s finances, property, or medical care. The benefit of having a Power of Attorney document in place is that the person you designate can address and control your personal issues when you’re no longer capable of doing it yourself. Here are 3 things to know about Power of Attorney:

1. A Power of Attorney for Health Care is the most common document that funeral directors are in contact with. “This Power of Attorney gives another individual the authority to make your health care decisions for you if you become unable to do it,” explained John Adolf, Director of Adolf Funeral Services. “It also gives that individual the authority to make funeral service decisions in case the deceased didn’t make his or her own arrangements in advance.”

2. A Power of Attorney for Property document gives an agent the authority to make day-to-day financial decisions if you’re unable to do it yourself. This type of POA terminates at your death.

3. It’s important to put a lot of thought into selecting an agent. “There are three important attributes to consider when selecting an individual to receive your Powers of Attorney,” said Adolf. “Choose someone who is trustworthy, someone who is capable of handling important and sometimes uncomfortable situations, and someone who is dependable and understands the importance of their obligation.”

In the event your original agent is unable or unwilling to make these decisions on your behalf, it’s wise to select a contingent agent who can take the reins. “As with most important life decisions, I advise people to seek out an expert in the area of concern,” added Adolf. “In this case, that would be an Attorney at Law.”
