Batavia man being held on $150K bond on armed violence charge, other felonies

Suspect allegedly possessed loaded handgun, cocaine

BATAVIA – A Batavia man was charged with armed violence, possession of a firearm by a gang member and possession of a controlled substance, all felonies, according to a Batavia police report released after a Freedom of Information Act request.

Adrian Martinez, 22, of the 1100 block of Lorlyn Circle, Batavia, was also charged Aug. 4 with possession of a firearm by a felon; possession of ammunition by felon; possession of a firearm without a FOID card; and manufacture or delivery of a controlled substance, all felonies, according to court records.

Martinez was also charged with unlawful possession of drug paraphernalia and ammunition without a valid FOID card, both misdemeanors, court records show.

Martinez is currently being held in the Kane County jail on $150,000 bond, records show. He would have to post $15,000 or 10% in order to be released. Martinez’s next court date is Sept. 23.

Batavia police were first called to the Lorlyn Circle apartment complex shortly before noon on Aug. 2 in response to a domestic disturbance that was later reclassified as armed violence incident, the report stated.

The complainant told police Martinez had just left on foot possibly in possession of a handgun inside a backpack, the report stated.

Officers found him two blocks away and told him he was being stopped because he was wanted on a warrant from Aurora police, the report stated.

Officers found a chrome colored 9 mm Smith & Wesson handgun with 14 rounds in the magazine, which was loaded inside the gun, and a separate box of ammunition with 44 rounds of 9 mm ammunition, the report stated.

Police also found dollar bills with a white powdery residue and a digital weighing scale with the same residue, both testing positive for cocaine, the report stated.

Police also found a chunky substance tied inside a sandwich baggie weighting 4.1 grams and a white plastic tablespoon with a powdery residue, all testing positive for cocaine, the report stated.

Police also found more than 50 unused baggies commonly used for the packaging and sale of narcotics, the report stated.

Martinez was previously convicted for felony aggravated fleeing a police officer on Nov. 13, 2020, with a sentence of 180 days in jail and 24 months of probation to end Nov. 14, 2022, according to court records and the police report.

The most serious charge Martinez faces is armed violence, a Class X felony punishable by six to 30 years in prison and fines up to $25,000, if convicted.

Illinois statutes define committing armed violence as being armed with a dangerous weapon while committing any felony defined in state law.

The manufacture or delivery of a controlled substance is a Class 1 felony, punishable by four to 15 years in prison, or up to 48 months of probation, if convicted.

Court records show Martinez pleaded guilty to two charges of domestic battery on Nov. 19, 2020 in connection with a July 4, 2020 incident at the same address in the 1100 block of Lorlyn Circle, Batavia.
