A Crete man is facing a misdemeanor charge after he posted a nude photo of an elderly woman on Snapchat in an attempt to embarrass her, according to police and court records.

About 7 p.m. Thursday, Justyn Martinez, 21, of the 24000 block of South Loomis Street was arrested and taken to the Will County jail on a charge of attempted nonconsensual dissemination of private sexual images.

Martinez’s arrest was the result of an investigation involving him taking a “naked photograph” of a 62-year-old female roommate and “disseminating the photograph on Snapchat without her knowledge or consent in his attempt to embarrass her,” said Steger Police Chief Patrick Rossi.

Nonconsensual dissemination of private sexual images, commonly known as “revenge porn,” is a criminal offense under Illinois law.

The term “revenge porn” is somewhat misleading as many perpetrators are not motivated by revenge or any personal feelings toward the victim, according to nonprofit organization Cyber Civil Rights Initiative.

“A more accurate term is nonconsensual pornography, defined as the distribution of sexually graphic images of individuals without their consent,” CCRI said.

In 2014, former Gov. Pat Quinn signed a law that made nonconsensual dissemination of private sexual images a class 4 felony, which is punishable by up to 3 years in prison.

Last October, the Illinois Supreme Court determined nonconsensual sharing of private sexual images doesn’t fall under the protections of free speech, according to the Northwest Herald.
